SALES CONDITIONS

The site www.tinykidz.com is the property of the company “KyoSoft Limited” of which the head office is located at 18 Sandy Lane, Weaverham, Northwich, Cheshire CW8 3PX, England, in it’s totality, as well as the associated relevant rights. All reproduction, partial or total of the site is formally forbidden.

Introduction
The sales conditions are exclusively under French law. All the products proposed are regulated under French intellectual property law. All reproduction, either partial or total of the site or products is formally forbidden. However, hypertext links to the site are permitted upon request.

Article 1 Sales Application
The customer acknowledges having taken knowledge, at the moment of the order, the particular conditions announced on this screen and declares having accepted without reserve. The present general conditions provide the contractual relationship between the company “KyoSoft” and its client, both parties accept without reserve.

Article 2 Products
The products which appear on the site www.tinykidz.com are printed by professionals. However, the visual aspect of on the site can not reproduce perfectly the colours and textures of the final product. In addition each site visitor, according to his system settings (computer and screen) can have a modified appearance from the reality.
As a consequence, the responsibility of the seller will not be engaged due to a marginal difference between the viewed colours and the colours in the delivered product or the texture of the paper/frame. In no case can this justify a refusal of the delivery.

Article 3 Order
The information published by the buyer during the order placement are binding. In case of error in the delivery the seller is not bound by the impossibility to deliver the product. In effect the customer is bound by the responsibility to indicate an exact delivery address during normal working hours .

During the taking of the text by the client at the moment of the order, all error in terms of text, page layout, police or other is at the responsibility of the client. The text and images are an identical reproduction of the information entered.

Tiny Kidz engages to respect an order, to send a confirmation mail which is in effect the acknowledgement of the order. No order can be registered before having received this confirmation mail.

The client is obliged to pay the totality of his order upon reception of the confirmation mail which is sent. All orders shall be honoured within a delay which can very between 3 days and 5 days for the print kit from reception of the payment, and one week to two weeks for all personalised gifts from reception of the prints.

Article 4 Delivery and Reception
No delivery shall be effected without total payment of the invoice.

The delivery shall be effected by La Poste en colissimo registered or chronopost.

The delivery in a European Union country shall be sent by La Poste en Collissimo registered Europe or chronopost depending on the choice of the customer. The delivery outside of the European union shall be sent by International post or chronopost depending on the choice of the customer.

The products whilst being transported shall be under the responsibility of the transporter. If at the reception of the parcel, it’s state is damaged (parcel open or diminished) the customer has the responsibility to signal this at the moment of delivery.
All late delivery shall not undertake the responsibility of the supplier “KyoSoft” and does not constitute a motif for repayment, or refusal of the delivered product.

Article 5 Invoicing and Payment
The price is expressed in £ sterling.
The indicated price for the products in the on line shop does not include transport & packaging. The indicated price in the order confirmation is the final price, expressed with all relevant taxes and including the Value Added Tax for the U.K and the countries within the European Union.

The company “KyoSoft” reserves the right to cancel all order for which payment is not received within 10 working days after its validation, that is to say after the mail confirmation of the order.

The price may be modified at any moment without notice and without responsibility of the company. Only the prices indicated at the moment of the order, and confirmed by the sending of a confirmation e-mail for the order shall be considered.

Each and every order, irrespective its origin is payable in Euros (excluding the U.K which is in £) integrally, by a bank / postal cheque or Visa upon reception of the order email confirmation. The printing of the order shall only be completed after the full payment of the order. In case of refused payment the order shall be automatically cancelled and the customer notified by electronic mail.

Article 6 Annulations Rights
The customer has the right to retract conforming to the article L121-20-2 du Code de la consummation which applies to products having a strong personalised character destined for the.

Article 7 Guaranty
The company KyoSoft guarantees a one year guaranty.

Article 8 Application Rights – Conflict
The present general sales conditions are under French law. In case of conflict the client should address by priority the company to obtain an agreed solution.
Failing, the Tribunal de Commerce de Valenciennes is the sole competent authority whatever the delivery destination and the mode of accepted payment.

Article 9 Computing Law and Freedom
The provision of nominative information in order to provide distance selling is obligatory, this information being indispensible to treat the order, to establish invoices and contractual guaranties, the non provision of information nullifies the order . Conforming to the law “Informatique et Libertés", the treatment of this information relative to the client falls within a declaration to the Commission Nationale de l'Informatique et des Libertés (CNIL). The client has available (article 34 of the law 6 janvier 1978) the right of access, of modification, of rectification and the suppression of data of which he is concerned, of that which KyoSoft is able to apply from the company KyoSoft. Additionally, the company KyoSoft engages to non disclosure, freely or with payment, the data of the customer to a third party.
